Nomination and delivery procedure TTO:
PROCEDURE
1. Seller and Buyer sign SPA. Buyer return signed SPA to Seller with complete with banking details and ATB format.
2. Buyer sign an indemnity with seller that he will place $1million instrument from reputable international bank with seller. Seller accept only BG or MT799 Bank Blocked Fund or SBLC.
3. Seller issues ATB And Clearance to buyer for his confirmation
4. (a)Buyer places financial instrument of $1million to seller as clearly specified in item no-2 above.
(b)Seller at his own expense board buyer freely on Nigerian waters for Q and Q
(c)If inspection is to be done outside Nigerian waters or international waters full financial instrument will be placed by buyer as specified in no-2 above
5. On arrival of vessel at International waters/point of take-over, with Buyer’ssuper cargo on board, Seller’s vessel issues a second marine (MATB) to Buyer’sinspectors to board and conduct Q & Q for payment.
6. Upon receipt and confirmation of inspection report, Buyer’s bank acts on clause 4, above in conformity with the Q&Q report.
7. Upon confirmation of buyer’s payment instrument by seller’s nominated bank, Seller hands over all original cargo document including title of ownership to buyer for a complete take-over of vessel and cargo.
8. Buyer takes over control of vessel and instructs his captain forthwith.
