CIF MED/EU/ASIA

A) Vessels provided by the seller

1. SELLER AND BUYER SHALL SIGN THE CONTRACT AND EXCHANGE CONTRACT

2. SELLER EXECUTES / ABIDES BY TERMS AND CONDITIONS OF CHARTER PARTY AND AGREED VESSEL/VESSEL SIZE FOR THE PURPOSES OF THIS CONTRACT, BUYER CONFIRMS ACCEPTANCE OF NOMINATED VESSEL OR REQUESTS SUBSTITUTE.

3. SELLER PROVIDES BUYER WITH PROOF OF PRODUCT AND AN ACCEPTABLE OPERATIVE PERFORMANCE BANK GAURANTEE EQUIVALENT TO 2% OF THE FACE VALUE OF THE LETTER OF CREDIT.

4. BUYER ISSUES DOC. L/C IN FAVOR OF SELLER .

5. AT LOADING PORT VESSEL GIVEN NOR AND LOADING COMMENCES.

6. AFTER LOADING MASTER OF VESSEL SHALL GIVE ETA DISCHARGE PORT.

7. AFTER LOADING SELLER SHALL PROVIDE BUYER WITH COPY OF FULL SET SHIPPING DOCUMENTS

8. SELLER WILL SUBMIT THE SHIPPING DOCUMENTS TO THE BUYERS BANKS FOR THE CLAIMING OF THE LETTER OF CREDIT. .

9. AT DISCHARGE PORT MASTER OF VESSEL TENDERS NOR AND BUYER NOMINATES THE SURVEYOR TO EVALUATE THE CARGO QTY AND QLY AT DESTINATION PORT, BEFORE THE COMMENCEMENT OF THE DISCHARGE OPERATIONS.

10. AFTER INSPECTION SELLER SHALL PRESENTS DOCUMENTS TO BUYER’S BANK FOR PAYMENT OF THE 100% VALUE OF THE CARGO BASED ON THE SURVEYOR REPORT, ISSUED BY THE SURVEYOR AT THE DESTINATION PORT.

11. PAYMENT RELEASED BY THE BUYER AND THE VESSEL WILL BE ALLOWED FOR DISCHARGE BY THE SELLER UPON THE RECEIPT OF THE PAYMENT WHERE THE SELLER WILL INSTRUCT THE VESSEL MASTER TO RELEASE THE CARGO.

B) Vessels provided by the buyer

1. SELLER AND BUYER SHALL SIGN THE CONTRACT AND EXCHANGE CONTRACT
2. SELLER AND BUYER AGREE TO CHARTER A SUITABLE VESSEL ON BEHALF OF SELLER, OF WHICH CHARTERING SERVICES WILL BE PROVIDED BY THE BUYER EXCLUSIVELY. TERMS AND CONDITIONS OF CHARTERING SAID TANKER WILL BE OF TYPICAL MARINE PRACTICES WHICH ARE STANDARD WORLDWIDE BOTH IN PRICING AND TERMS.
3. SELLER WILL PROVIDE BUYER PRIOR TO SHIP BALLASTING TO LOAD PORT PROOF OF PRODUCT DOCUMENTS REQUIRED. UPON RECEIPT OF LOADING TERMINAL APPROVAL OF VESSEL BUYER LIFTS SUBJECTS ON VESSEL AND ISSUES AND VESSEL’S MASTER WILL GIVE ETA TO LOADING PORT.

· NOT LATER THAN FIVE DAYS FROM THE SIGNING AND EXCHANGE OF THIS CONTRACT SELLER WILL PROVIDE THE BUYER WITH THE FOLLOWING PROVE OF PRODUCT DOCUMENTS;

· LETTER OF OFFER FROM NNPC TO SELLER

· FRONT AND BACK PAGE OF CONTRACT BETWEEN NNPC OR NNPC SUBSIDIARY SUPPLIER OF RECORD AND SELLER

LOADING LAY-CAN DATE RANGE INCLUDING THROUGH PUT ARRANGEMENTS CONFIRMED BY TERMINAL OPERATORS TO BUYER SHOWING [ our company ] AS CONSIGNEES
4. BUYER ISSUES OPERATIVE DOC. L/C IN FAVOR OF SELLER
5. AFTER LOADING SELLER SHALL PROVIDE BUYER WITH COPY OF FULL SET OF NEGOTIABLE SHIPPING DOCUMENTS AND DISP OWNERS SHALL GIVE ETA TO DISCHARGE PORT
6. AT DISCHARGE PORT DISP OWNERS IN AGREEMENT WITH SELLER TENDER NOR AND COMMENCE DISCHARGE.
7. AFTER DISCHARGE AND INSPECTION SELLER SHALL PRESENTS DOCUMENTS TO BUYER’S BANK FOR PAYMENT.
